1. Acceptance of Terms

By accessing or using Eclayr, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not access or use our services.

2. Services Provided

Eclayr offers a platform for connecting clients seeking mental health support with licensed therapists. The services we provide include, but are not limited to:

• Booking and scheduling therapy sessions

• Virtual therapy (via video, audio, or chat)

• Therapist profiles and client reviews

• Payment processing for therapy sessions

The Platform does not provide medical or psychological advice directly and is not a substitute for professional care. You should always seek the advice of your therapist, physician, or other qualified healthcare providers with any questions you may have regarding your mental health.

3. Eligibility

• Clients:

  To use our services, clients must be at least 18 years old or have legal guardian consent. Clients must also agree to provide accurate personal and health information as required for the booking of services.

• Therapists:

  Therapists must be licensed and registered with the appropriate regulatory bodies in India. By using the Platform, therapists confirm that they possess the required qualifications, licenses, and certifications.

4. Registration and Account Creation

To use the services, both clients and therapists must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Services for Clients

• Therapist Selection:

  Clients can browse therapist profiles, review their qualifications, specialties, and reviews, and choose a therapist that meets their needs.

• Appointments:

  Clients can book appointments with therapists via the Platform. It is your responsibility to ensure that the chosen therapist and the appointment time suit your needs.

• Cancellation Policy:

  Clients must adhere to the cancellation and rescheduling policy as outlined in the platform. Typically, cancellations should be made at least 3 hours before the scheduled session to avoid charges.

• Payment:

  Payment for therapy sessions is processed via the Platform at the time of booking. All payments are final and non-refundable except as otherwise stated in our cancellation policy.

6. Services for Therapists

• Profile Creation:

  Therapists must create a profile that includes their qualifications, specialties, and other relevant information. You are responsible for ensuring that your profile is accurate and up to date.

• Session Management:

  Therapists are responsible for managing their availability and ensuring timely attendance to sessions. Therapists may set their working hours within the Platform.

• Payment:

  Therapists will receive payment for services rendered, less applicable service fees, through the Platform. Payments will be processed according to the payment schedule set by Eclayr.

7. Confidentiality and Privacy

Both clients and therapists are required to maintain the confidentiality of the information shared during therapy sessions. Eclayr will adhere to all applicable data protection laws in India, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

• Clients:

  Your personal and health data will be kept confidential in line with our Privacy Policy.

• Therapists:

  Therapists are required to comply with all legal and ethical standards for maintaining the confidentiality of client information.

8. Conduct and User Responsibilities

• Clients:

  You agree to use the Platform respectfully, adhering to the guidelines for appropriate behavior. You must not use the Platform for illegal purposes or engage in harassment or abuse.

• Therapists:

  You agree to provide services in a professional and ethical manner, adhering to applicable mental health and medical ethics standards. You should not engage in any behavior that may harm clients or violate legal or ethical codes of conduct.

9. Prohibited Conduct

Users are prohibited from:

• Engaging in illegal activities or using the Platform for unlawful purposes

• Attempting to defraud other users or manipulate reviews and ratings

• Sharing or distributing content that is harmful, defamatory, obscene, or offensive

• Violating any intellectual property rights

10. Termination and Suspension

We may suspend or terminate your account if you violate these Terms or engage in any conduct that we believe is harmful to the Platform or its users. Clients may terminate their account at any time by contacting customer support. Therapists may also terminate their account at any time by following the proper procedures.

11. Limitation of Liability

To the maximum extent permitted by law, Eclayr and its affiliates, officers, employees, or agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with the use of the Platform, including but not limited to loss of data, services, or business opportunities, or any other loss or damage.

12. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved through informal negotiations. If the matter cannot be resolved, it shall be subject to arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The venue of arbitration shall be India, and the language of arbitration shall be English.

13. Indemnification

You agree to indemnify and hold harmless Eclayr, its affiliates, officers, employees, and agents from any claim, loss, damage, or expense (including legal fees) arising from your use of the Platform or your violation of these Terms.

14. Changes to Terms

Eclayr reserves the right to modify or update these Terms at any time. Any changes will be communicated to you via email or through the Platform. Your continued use of the Platform after the changes have been made will constitute your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
